These Terms and Conditions apply to the FloPOS website, documentation, downloads, community channels, support channels, and related public project materials made available by Codify Apps Private Limited.

1. Agreement to these terms

By accessing the FloPOS website, downloading FloPOS, installing FloPOS, joining a FloPOS community channel, contacting support, or using the software in any way, you agree to these Terms and Conditions, the Privacy Policy, and the No Warranty Disclaimer.

If you do not agree, do not download, install, deploy, or use FloPOS.

If you accept these terms on behalf of a company, restaurant, organization, or other entity, you confirm that you have authority to bind that entity.

2. Open-source license

FloPOS is free and open-source software. The software is distributed under the MIT license from the official project repository.

The MIT license grants broad rights to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the software, subject to the license conditions, including preservation of copyright and permission notices.

The MIT license also states that the software is provided "AS IS", without warranty of any kind, and that authors or copyright holders are not liable for claims, damages, or other liability arising from use of the software.

If there is any conflict between these website terms and the MIT license regarding rights to the software code, the MIT license controls the software license rights.

3. Eligibility and business use

FloPOS is intended for businesses, operators, developers, installers, and adult users evaluating or operating restaurant point-of-sale workflows.

You are responsible for ensuring that your use of FloPOS is lawful in your country, state, region, and industry.

You must not use FloPOS for unlawful activity, fraud, unauthorized data collection, unauthorized payment handling, or any activity that violates applicable law.

4. Permitted use

Subject to the MIT license and these terms, you may download, install, test, use, inspect, modify, and deploy FloPOS.

You are responsible for your own deployment decisions, including hardware choice, network configuration, operating system maintenance, user access, backups, updates, and local compliance requirements.

You must not misrepresent FloPOS as a paid proprietary product of your own without preserving required license notices, copyright notices, and attribution obligations under the applicable open-source license.

5. User responsibility

You are solely responsible for evaluating whether FloPOS is suitable for your restaurant, business, staff, country, taxes, accounting, payment workflow, hardware, and operating environment.

You are responsible for:

  • Testing the software before live use.
  • Confirming legal, tax, invoice, receipt, payment, privacy, labor, and accounting requirements.
  • Verifying printer, scanner, cash drawer, kitchen display, network, and device compatibility.
  • Maintaining secure passwords, staff roles, device access, and physical device security.
  • Creating, storing, and testing backups.
  • Maintaining your operating system, hardware, database, and local deployment environment.
  • Training staff and creating internal operating procedures.
  • Reviewing releases and testing updates before production deployment.

6. Production use and live service

Do not use FloPOS in live restaurant service until you have completed your own acceptance testing.

At a minimum, test menu setup, taxes, discounts, receipts, printers, kitchen display, staff roles, payments, refunds, reports, backups, restore process, network failures, and device failures.

FloPOS may not be suitable for every restaurant, country, payment method, tax regime, hardware setup, or compliance requirement. You assume all risk from production use.

7. Data, privacy, and backups

FloPOS is designed around local/self-controlled data. Your restaurant data, customer data, sales records, menu data, staff data, and operating data are your responsibility.

Codify Apps Private Limited does not guarantee recovery of your database, backups, transactions, reports, or other business records.

You are responsible for privacy notices, customer consent, data retention, access control, breach response, backups, exports, deletion, and compliance with applicable privacy laws.

8. Support channels

FloPOS may offer WhatsApp, email, documentation, community, and GitHub support channels. Unless a separate signed written agreement states otherwise, all support is best-effort only.

Best-effort support does not create a warranty, uptime commitment, emergency response obligation, service-level agreement, maintenance contract, legal advice relationship, or professional services obligation.

We may decline, delay, moderate, or close support requests that are abusive, unclear, unrelated, unsafe, unlawful, or outside project scope.

9. Community channels

FloPOS community channels, including WhatsApp groups or future social/community platforms, are provided for discussion, announcements, peer help, feedback, and education.

You must not post spam, harassment, illegal content, personal data without permission, confidential business data, malware, misleading claims, or abusive messages.

Community advice may come from other users and may be incomplete or incorrect. You are responsible for verifying advice before applying it to your business.

Codify Apps Private Limited may remove users, delete posts, restrict access, or close community channels at any time.

10. Third-party services and integrations

FloPOS may link to or interact with third-party services such as GitHub, app stores, operating systems, payment providers, delivery platforms, printers, WhatsApp, email providers, hosting providers, or social networks.

Those services are operated by their respective providers and are governed by their own terms, privacy policies, fees, availability, and security practices.

Codify Apps Private Limited is not responsible for third-party service downtime, data loss, fees, policy changes, account restrictions, hardware incompatibility, or integration behavior.

11. No warranty

FloPOS is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, whether express, implied, statutory, or otherwise.

To the maximum extent permitted by law, Codify Apps Private Limited disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, reliability, availability, compatibility, and error-free operation.

Codify Apps Private Limited does not warrant that FloPOS will meet your requirements, comply with your local laws, work with your hardware, prevent data loss, prevent business interruption, prevent fraud, or operate without bugs or security issues.

12. Limitation of liability

To the maximum extent permitted by law, Codify Apps Private Limited, its directors, officers, employees, contractors, contributors, maintainers, affiliates, and licensors will not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages arising from or related to FloPOS.

This includes, without limitation, loss of profits, loss of revenue, loss of sales, loss of business, business interruption, data loss, corruption of data, inaccurate reports, tax or accounting errors, payment problems, printer failures, hardware failures, security incidents, customer claims, staff misuse, legal penalties, compliance failures, or costs of substitute software or services.

This limitation applies whether the claim is based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory, even if advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the greatest extent permitted by law.

13. Indemnity

You agree to defend, indemnify, and hold harmless Codify Apps Private Limited, its directors, officers, employees, contractors, contributors, maintainers, affiliates, and licensors from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • Your use, deployment, modification, redistribution, or operation of FloPOS.
  • Your restaurant, staff, customer, tax, payment, privacy, accounting, or compliance practices.
  • Your data, backups, hardware, network, third-party integrations, or security controls.
  • Your violation of these terms, applicable laws, third-party rights, or open-source license obligations.

14. Changes to these terms

We may update these terms from time to time. When we do, the "Last updated" date should be revised.

Continued access to the website, community channels, support channels, downloads, or software after changes are posted means you accept the updated terms.
